Our 1st available opening is the beginning of February but I expect it to be filled quickly so please let me know if you would like to get scheduled.

Our payment schedule is as follows: $500 deposit to get on the calendar, 1/2 of remaining balance during color consultation to order materials, full remaining balance due once project is completed.

Terms and Conditions

DESCRIPTION OF SERVICES

Beginning on start of service date, Red Tulip Designs LLC will provide to CUSTOMER the following painting services (collectively, the "Services"):

Kitchen cabinet painting. (colors to be determined at color consult) Both sides of doors and box exterior only will be sprayed. Interior of cabinets not included. See Cabinet Refinishing System for process. Doors/ drawer faces will be completed at Red Tulip Designs LLC and boxes will be sprayed on site.

 

PAYMENT

Payment shall be made to Red Tulip Designs LLC, of 2729 M & K Lane El Reno, OK 73036. 

If paying by credit card a 3.5% processing fee will be applied to the payment. If you do not want to pay the processing fee you may pay by check or ACH.

 

PAYMENT SCHEDULE (Residential Clients)

Scheduling Fee: $500.00 with Signed Contract.  This will secure start date.

Second payment- 1/2 of remaining balance due on date of color consultation.

Completed Project all remaining balance due at date of completion.

In addition to any other right or remedy provided by law, if CUSTOMER fails to pay for the Services when due, Red Tulip Designs LLC has the option to treat such failure to pay as a material breach of this Contract, and may cancel this Contract and/or seek legal remedies.

*Countertops- Countertops are not included in cabinet refinishing estimate and are sent on a separate invoice. Countertop payment schedule is 50% up front to schedule through countertop company and remaining balance due upon completion of countertop install. 

 

SCOPE OF WORK

a.  Red Tulip Designs LLC shall insure the painting surfaces are free from dust, dirt, mildew, fungus, loose materials, faults, defects and otherwise properly prepare the surface to receive the paint, that insures complete even coverage and adequate adhesion of the paint to the surface. Red Tulip Designs LLC agrees not to begin work until the surfaces to receive paint are clean, dry, free of defects, firm and sound to design shape.

b. Upon completion, the painted surface shall be uniform in appearance; with complete coverage; free of runs, sags, and skips; with sharp clean edges, when finishes join other materials or colors; smooth without roughness, (excepting those surface materials whose natural texture is roughness, such as rough cedar beams and siding, textured siding, etc.); and pleasing to the eye.

c. Red Tulip Designs LLC is responsible for all scheduling delivery of all painting materials. Painting

Company is responsible for the clean-up of any splatters caused during painting.

d. Red Tulip Designs LLC uses low tack painters tape and a rubberized floor covering to protect your floor. If the floor finish is damaged by low tack painters tape it is a sign of a failed/ improper finish and is the liability of the flooring company not Red Tulip Designs LLC.

e. Popcorn ceilings can be fragile. Red Tulip Designs works hard to protect clients ceilings but tape can damage popcorn ceilings. Red Tulip Designs LLC is not responsible for this damage.

 

INSURANCE

Red Tulip Designs LLC shall maintain general liability insurance for cabinet refinishing services only. Countertop installation is covered by countertop company and Red Tulip Designs LLC shall not bear responsibility.

 

CANCELLATION

If client wishes to cancel a 45 day notice is required to receive a refund. If supplies have already been purchased then refund will be total minus cost of supplies and scheduling fee. Because we have invested time into your project, a $100 processing fee will be deducted from all refunds.

 

CHANGES TO SCOPE OF WORK:

CUSTOMER may make changes to the scope of the work, from time to time during the term of this Contract. However, any such change or modification shall only be made by written "Change Order" signed by both parties. Such Change Orders shall become part of this Contract. CUSTOMER agrees to pay any increase in the cost of the painting services as a result of a Change Order. In the event the cost of a Change Order is not known at the time a Change Order is executed, the Red Tulip Designs LLC shall estimate the cost thereof and CUSTOMER shall pay the actual cost whether or not it is in excess of the estimated cost.

RESCHEDULING:

If CUSTOMER wishes to reschedule project start date less than 45 days in advance, a $500 rescheduling fee will be charged by RED TULIP DESIGNS.

WARRANTY

a. All materials and installations incorporated into the work shall be new, unless otherwise specified, and shall be of good quality. Red Tulip Designs LLC agrees to repair any peeling, deteriorating, fading paint surfaces caused by workmanship defect for a period of ONE year, and Red Tulip Designs LLC shall not be responsible for mildew or fungus that may form on painted surfaces. Red Tulip Designs LLC shall not be responsible after this period. Red Tulip Designs LLC shall not be responsible for builders' negligence. In the event, of peeling, deteriorating, fading paint surfaces within the warranty period and through fault of Red Tulip Designs LLC, then Red Tulip Designs LLC agrees to repair within 30 days of notice, weather permitting. Red Tulip Designs LLC’s obligation to effect repairs, as described above in this paragraph, is the only guarantee or warranty provided by Red Tulip Designs LLC to CUSTOMER with respect to the agreed work.

b. This warranty excludes, and in no event will Red Tulip Designs LLC be responsible for consequential or incidental damages caused by accident or abuse, temperature changes, settlement or moisture, i.e., cracks caused by expansion and/or contraction such as where rails and stiles meet. Cracks will be properly prepared as indicated at time of job but will not be covered under this warranty.

c. Wood is hygroscopic which means it expands and contracts with moisture fluctuations. Painted surfaces telegraph that where you have joints in the wood i.e., floating panels. Panels may shrink and have a “halo effect” in dry conditions. This is not considered a defect and is not a warrantable callback. It is a normal characteristic of using wood in cabinet construction. To minimize the appearance issues, home humidity levels must remain between 30-60%. Consult with your HVAC professional to address your home’s specific conditions.

d. Warranty for countertops and sinks are administered by designated countertop company. Red Tulip Designs LLC is not responsible for any warranty claims for countertop installation.

 

APPLIANCES

Client is responsible for moving appliances. Red Tulip Designs will not move appliances and work may be delayed if appliances are not moved from work area. A fee may be charged to the client for delay of work.

 

DEFAULT

The occurrence of any of the following shall constitute a material default under this Contract:

a. The failure to make a required payment when due.

b. The insolvency or bankruptcy of either party.

c. The subjection of any of either party's property to any levy, seizure, general assignment for the benefit of creditors, application or sale for or by any creditor or government agency.

d. The failure to make available or deliver the Services in the time and manner provided for in this Contract.

 

ENTIRE AGREEMENT

This Contract contains the entire agreement of the parties, and there are no other promises or conditions in any other agreement whether oral or written concerning the subject matter of this Contract. This Contract supersedes any prior written or oral agreements between the parties.

 

FORCE MAJEURE

If performance of this Contract or any obligation under this Contract is prevented, restricted, or interfered with by causes beyond either party's reasonable control ("Force Majeure"), and if the party unable to carry out its obligations gives the other party prompt written notice of such event, then the obligations of the party invoking this provision shall be suspended to the extent necessary by such event. The term Force Majeure shall include, without limitation, acts of God, fire, explosion, vandalism, storm, illness or other similar occurrence, orders or acts of military or civil authority, or by national emergencies, insurrections, riots, or wars, or strikes, lock-outs, work stoppages, or supplier failures. The excused party shall use reasonable efforts under the circumstances to avoid or remove such causes of non-performance and shall proceed to perform with reasonable dispatch whenever such causes are removed or ceased.
